What is a remortgage?

Remortgaging is when you change the mortgage on your property by moving to a new lender. At John Hodge Solicitors, our conveyancing lawyers can assist you whether you are remortgaging to secure a better deal, borrow more money, or because your circumstances have changed (for example due to divorce or relationship breakdown).

Should you remortgage? 

Remortgaging has the potential to save you a lot of money. However, before committing, you should check the terms of your current mortgage and seek the advice of a mortgage broker or independent financial adviser. If you are looking to remortgage then you may, for example, have to pay early repayment charge in respect of your existing mortgage (usually between 1% of 5% of what you still owe on your mortgage agreement) and there may be further additional costs - such as application and survey fees - that might affect your decision to proceed. 

If the costs of switching deals exceeds the amount you would save by sticking with your current mortgage, then you may not consider it financially viable to proceed with a remortgage. We do however strongly recommend that you speak with a mortgage broker or independent financial adviser before making a final decision. 

Do I need a solicitor to remortgage with the same lender?

You may not need a conveyancing lawyer for remortgaging with the same lender if you are getting:

  • An advance (additional borrowing) on your existing mortgage
  • A ‘product transfer’, which means simply moving to a new rate or deal

Do I need a solicitor to remortgage with a different lender?

Typically remortgaging with a different lender will involve your current mortgage be repaid in full and replaced with a new mortgage. You will need a conveyancing lawyer to deal with the formalities, such a liaising with the new lender, reviewing the mortgage documentation and updating HM Land Registry.
